MASHINBAJAR serves only as a platform for the purpose of facilitating information and providing business flow between buyer and Owners. MASHINBAJAR is neither a lesser/Lender/Owner nor a lessee/Borrower/Renter of any Equipment. MASHINBAJAR is not a party to any agreement entered into between the Buyer and the Owners. The Buyer and the Owners may create or use their own terms and/or modify or use as it is the terms mentioned in their . All rights and obligations arising out of any agreement are binding exclusively on the Buyer and Owners. Buyer shall verify all the documents and equipment before making payment. Nature of personal information collected The information (which shall also include data) provided by you to Mashinbajar or collected from you by Mashinbajar may consist of Personal Information. Personal Information for the purposes of this Privacy Policy shall include, but not be limited to: Price The price will be negotiated between buyer and owner which will vary from market to market as well as based on demand also. Order & Confirmation of Order Mashinbajar will connect Buyer and owner through use of its digital platform. It is responsibility of owner to update status of equipment on Mashinbajar platform if there order are confirmed. Bill All the bills/ order sheets/ challans will be responsibility of owner to generate as per there mutual agreement. Mashinbajar is just a bridging partner and will not be liable for anything. Delivery The delivery of Equipments will be managed by buyer & owner falling between the two parties linked with incentives and penalties. Encumbrance The Renter shall not sell, assign, sub-let, pledge, hypothecate or otherwise encumber or suffer a lien upon or against the said raw material/ machines/ equipments etc. and the owner shall undertake to abide by the same. Due To Verify Title It is the duty of the buyer to verify the title of the Equipments so delivered by the Owners by employing their resources. Warranty Disclaimer MASHINBAJAR makes no representations or warranties regarding the accuracy of descriptions anywhere on the Service, or regarding suggestions or recommendations of equipments offered through the Service. User warrants that it has undertaken its own investigation of all matters relating to the Equipments provided, including an investigation as to the condition of the equipment provided by another User, and therefore has not received or relied upon any statements or representations made by MASHINBAJAR concerning such matters. Disputes Between Users of Services MASHINBAJAR reserves the right, but has no obligation, to monitor disputes between all the Users of its services. Users are solely responsible for their interactions with other Users (e.g. payment obligations). In case of any dispute, the Users shall not involve MASHINBAJAR and its Officers, Directors, Agents, Subsidiaries, Joint Ventures, Employees and Investors and their related Entities in any kind or nature, known and unknown, arising out of or in any way connected with such disputes. It is the responsibility of the Users to resolve their disputes expediently and individually. It is the sole discretion of MASHINBAJAR whether or not to assist any or all of the Users in resolving their disputes. Disputes Between mashinbajar & Users : Resolution All disputes arising out of or in connection with the use of service of MASHINBAJAR including questions regarding its existence, validity or termination of registration, shall, unless amicably settled between the parties, be finally settled by arbitration. Each party submits to the Jurisdictions of Courts of Indore, Madhya Pradesh for the purpose only of compelling compliance with the above arbitration provision and for enforcement of any arbitration award made in accordance with the above provision. Applicable Law This agreement shall be governed by and construed in accordance with the laws of India. Modification in the Services MASHINBAJAR shall have the right to add/ alter/ amend/ modify/ repeal any of the terms contained herein. It is the responsibility of the Users to regularly check for any such modifications. Termination This Agreement shall remain in full force and effect while User uses the Service. User may terminate User’s use of the Service at any time. MASHINBAJAR may terminate or suspend User’s access to the Service or User’s membership at any time, for any reason, and without warning, which may result in the forfeiture and destruction of all information associated with User’s membership. MASHINBAJAR may also terminate or suspend any and all Service and access to the Website immediately, without prior notice or liability, if User breaches any of the terms or conditions of this Agreement. Upon termination of User’s account, User’s right to use the Service, access the Website and any Content will immediately cease. All provisions of this Agreement which, by their nature, should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
